Safety & Terms and Conditions

KG Kayaks has been operating since 2001 and has an operators licence issued by Environment Bay of Plenty who regulate commercial water activity in the Bay of Plenty. This operators licence is issued after an annual inspection of equipment and review of safety procedures.
KG Kayaks also holds a Qualmark Silver award under the Sustainable tourism Business Criteria. Wider Health & Safety practices in our business are overseen by Think Safe New Zealand.
KG Kayaks employs only experienced local guides familiar with local conditions. Your safety and comfort are our priorities and we tailor our trips to meet the varying levels of experience, fitness and ability.

Terms and Conditions

Ohiwa NZ Ltd Terms & Conditions

KG Kayaks is the trading name for Ohiwa NZ Ltd.
When you book any of our products, you are agreeing to the following terms and conditions.

1. All clients are required to complete a Tour or Hire Agreement, sign our Safety Terms & Customer Responsibility Agreement ( this can be emailed to you on request) and undertake a KG Kayaks safety briefing prior to commencement of the tour or freedom hire.
2. KG Kayaks reserves the right to cancel or amend trips due to weather and/or sea conditions or otherwise in the interests of client safety. No refunds will be given if our trip is disrupted or cut short for this reason.
3. We require at least one person in each group to have, at least, a good understanding of English in order that they may translate basic instructions. This assists our guides to communicate essential safety information
4. Due to weight restrictions /safety parameters in the kayaks, we have a maximum weight limit of 100kg per person in single kayak and 120kg in a double kayak (the other person in the double kayak must be under 100kg)
5. When you book a hire or tour, you are fully responsible for the care and return of all equipment provided. KG Kayaks may claim the full cost of repairs or replacement of any item damaged or lost by you.

6. In any adventure activity, there is an element of risk involved. Risks in undertaking this activity include, but are not limited to, Personal Injury, Property Damage, Illness as a result of Adverse Weather Conditions and Risk of Drowning.
The Staff and Management of KG Kayaks take all practicable steps to identify and minimize potential dangers, however you must follow our instructions and use the safety equipment provided
All young persons under the age of 18 must be accompanied by an adult or legal guardian.
Adults accompanying a person under the age of 18 must ensure that the underage person follows our instructions at all times.
7. We reserve the right to withdraw any person who in our opinion is likely to endanger themselves or others. We also reserve the right to cancel any trip or activity if we become concerned for any reason for your safety or that of any other person. This option is exercised at the guide’s discretion depending on environmental factors and participant ability.
8. In the unlikely event you require medical treatment, which may be deemed necessary by KG Kayaks in the case of injury, accident or illness during the course of undertaking sea kayaking, you agree to indemnify KG Kayaks in respect of such medical treatment.

EXCLUSIONS: To the extent permitted by law, all our liability for damage to your property, disruption to travel plans, or mental injury is excluded. This exclusion is subject to any rights or remedies you may have under the Consumer Guarantees Act 1993.

CANCELLATION POLICY
All booking cancellations must be made via phone call / txt (0272724073) or email to kgkayaks@gmail.com within 48 hours of tour commencement or no refund will be given.
The above applies to direct bookings only. Bookings made through agencies may have their own terms and conditions.
Operating in the outdoor environment means that we are subject to weather & environmental conditions. While every effort will be made to reschedule your tour. If it is not possible to reschedule, a full refund will be given.
We encourage clients to have their own travel insurance.

Changes to Terms and Conditions: The Operator reserves the right to change these Terms and Conditions at any time without notifying users of this site

KG Kayaks is covered by $2M of public liability insurance.
